Mary Staunton Carter stated that she married Charles Carter about the year 1780 in Virginia. They then moved to Sumner County, Tennessee and lived happily together for Eleven years and had seven children. Charles then returned to Virginia and brought back with him, Milly Staunton, sister of Mary. Charles began to live openly with Milly and Mary filed for divorce in the Mero District Court in 1797. Charles prevailed on Mary to dismiss the suit, however, he continued to live with Milly. He and Milly also had seven children together. Mary went to Kentucky and was living in Livingston County, prior to 1830. After Milly died, Charles married Rebecca Pearson in 1820 and they had two children before his death in 1829.1

William Fuqua(y), a farmer born in North Carolina ca 1780, was in Jackson County, Tennessee by 1806 when he signed a petition. In 1812 he made improvements on his land in Jackson County on Martin's Creek. He was in all Jackson County census records for 1820 through 1860.
This Fuquay family may have been referred to as the "Big Springs Fuquay's." William's wife Nancy was born ca 1792 in Tennessee (though it was actually North Carolina until 1796) and died ca 1855. The Fuquay name originated in France. William died intestate, but a Bill of Complaint listing 19 children and various other heirs was filed in 1872 by a son, Andrew Thaxton Fuqua.1

It seems that Jane had arisen to build a fire and had started to the kitchen, which was away from the house, with a shovel of fire. On her way to the kitchen, Jane had a heart attack. It has also been said that Jane smoked a pipe. Tax and Jane lived in the Martin's Creek area and are buried at a place called Big Springs in that area.

Application to remove Guardian and have property returned.
Be it remembered that this cause came on to be heard before the court upon the application of the petitioner to set aside the judgment of this court declaring her a person of unsound mind and to restore her to the control of her own property and remove Wm. E. Fuqua as her guardian, upon full consideration of which and the proof introduced in said application the court was pleased to disallow said application except so far as to remove said Guardian. It appearing that said Guardian has not properly executed his said Trust according to law. It is ordered by the court that said Wm. E. Fuqua be removed as such Guardian of Jane Fuqua, and that he be required to make his settlement as such guardian before the November Term of this court 1892 and it approving that James Fuqua the former guardian of said Jane Fuqua has failed to make settlement as required by law. It is ordered that he also be required to make his settlement before 1st Monday in November next and that the clerk notify them accordingly. The defendant Wm. E. Fuqua will pay all the cost of this proceeding out of the funds property of Jane Fuqua's estate and execution will issue therefore.

Wm. E. Fuqua this day presented his final settlement as Guardian of Jane Fuqua, which settlement being unexcepted is by the court in all things confirmed and ordered to be recorded and the cause coming and to be further heard before this court an the application of Jane Fuqua for writ of possession to put her in possession of her land which had been held by her guardian the said Wm. E. Fuqua, pending the considerations of which the said Jane Fuqua and ___________ Fuqua entered into the following compromise agreement to wit: The said Fuqua being the tenant of Wm. E. Fuqua guardian agrees to surrender the immediate possession of all the lands, including the house and orchards and pasture, except that part of the same, that was in stubble the present spring for which he agrees to pay her the sum of thirty five dollars rent, the present year for which he executed to her, his promissory note together with as his security, retaining a lien on the products raised the present year to further secure the same. It was further agreed by the said Wm. E. Fuqua and ___________ Fuqua that they will surrender to the said Jane Fuqua the full and complete possession of that part of said land so rented this present year on the 1st January 1894 and that she the said Jane Fuqua may enter and take full possession thereof at that time. She can enter and take possession all the balance of said land immediately.
