John Darnabyand Edward Darnaby are to have an equal part with the rest of my grandchildren of all my estate excepting negroes, which I have given them inthe first part of my Will.

In case any of my grand children should die without heirs, then what Ihave given them is to be divided among the rest of my surviving grandchildren. -- 3 (431) -- My will and desire is that Richard Loring andThomas Minor, be executors of this my Last Will and Testament.

Will of Charles Sweeney.

In the name of God: Amen.

I, Charles Sweeney, of the County of Casey, and State of Kentucky, domake, ordain and declare this instrument of writing to be my last Willand Testament, hereby revoking all others.

First: All my debts, of which there are but few, are to be punctually andspeedily paid, and the legacies hereafter bequeathed are to be dischargedand paid as soon as circumstances will permit, and in the mannerhereafter directed.

Item: To my beloved wife Frances Sweeney, I give and bequeath the use andbenefit of my whole estate, both real and personal, for the time of hernatural life or to the right exercise of her reason, except parts thereofas are specifically disposed of hereafter.

Item: Having been blessed with a numerous family of children, and as mycapacity admitted have made to each advances of my living, but as yethave not made each equal, which it is my will and desire shall be done. Itherefore have taken a criterion to equalize each.

Item: My son Joel to whom I have given and advanced the sum of sevenhundred and twenty one dollars.

Second: I give and bequeath to my son Josiah, seventy three dollars andsixty three cents, he having received by advancement the sum of sixhundred thirty seven dollars and thirty seven cents.

Third: I give and bequeath to my son James, two hundred twelve dollarsand eighty nine cents, he having received by advancement five hundredeight dollars and eleven cents.

Fourth: I give and bequeath to my son Jonathan, two hundred forty threedollars and fifty cents, he having received by advancement four hundredseventy seven dollars and fifty cents.

Fifth: I give and bequeath to my son Jesse, three hundred twenty fivedollars, he having received by advancement three hundred and ninety sixdollars.

Sixth: I give and bequeath to my daughter Jincy (Mrs Jincy Snorgrass) twohundred eighty one dollars and forty three cents. She having received byadvancement four hundred thirty nine dollars and seven cents.

Seventh: I give and bequeath to my son Joshua two hundred sixty onedollars and fifteen cents, he having received by advancement four hundredfifty nine dollars and eighty five cents.

Eighth: I give and bequeath to my son Job, two hundred sixty eightdollars and forty five cents, he having received by advancement fourhundred fifty two dollars and fifty five cents.

Ninth: I give and bequeath to my son Jordan, one hundred twenty eightdollars, he having received by advancement five hundred and ninety threedollars.

Tenth: I give and bequeath to my son Jefferson, five hundred and threedollars, he having received by advancement two hundred and eighteendollars.

Which bequests as severally made, when added to the sum advanced, willmake each of my children a sum equal to the sum advanced to my son Joel,which legacies are to be raised and chargable on my estate, real andpersonal, upon the decease of my wife Frances, and paid to the said namedlegatees or their heirs, then.

Item: I give and bequeath to my son Josiah and his heirs forever, thetract of land I purchased from Richard Shackelford.

Item: The tract of land advanced to my son Josiah,

I hold only the bond of the said Richard Shackelford for a title, and asthe advancement as above I have charged him with five hundred dollars forthe same. It is my desire that he sustain no loss for the want of aperfect title in me to the said land, and I do in the event of my losingthe said tract of land, give and bequeath to my son Josiah, five hundreddollars, chargable on my estate, real and personal, and to be paid uponthe decease of my wife if the land is lost, or soon thereafter, or thetitle for the same shall be tested, settled upon the decease of my wifeFrances. The payment of my legacies here and before named and specifiedby division, or later, of my estate real and personal, I give andbequeath to each and every one of my children, whose names are hereonbefore mentioned, an equal share, division and portion of the residue ofmy estate, both real and personal, of whatsoever kind it may chance tobe.

I hereby nominate and appoint my sons Jonathan Sweeney and Joel Sweeney,Executors of this my last Will and Testament, hereby directing andauthorizing each or either of them to execute and carry into effect eachof my provisions herein, and with full power to sell and convey by deedor otherwise, my estate, real and personal, in possession, remainder orotherwise.

In witness whereof I have hereunto set my hand and seal this the seventhday of March, eighteen hundred and thirty two. (March 7th, 1832)

Codicil to the above Will.

By codicil to this my last Will and Testament, which is to be taken andconsidered a part thereof. I hereby will, emancipate and set free, at thedeath of my wife Frances, should she outlive me, my negro girl--Mary.

My son Jonathan, whom I appointed an Executor, having left the State, Ihereby nominate and appoint my son Jesse Sweeney, in conjunction with myson Joel, Executors of my last Will and Testament.

Witness my hand this February 13th, 1848.
